Collin County (Texas) Judge Angela Tucker on Wednesday dismissed a lawsuit accusing Dallas Cowboys quarterback Dak Prescott of sexual assault.

Dallas police announced last month that they would not pursue charges after an investigation determined there wasn’t enough evidence against Prescott to proceed with the case.

A woman filed a criminal complaint in March, alleging that Prescott sexually assaulted her in the back of an SUV in the parking lot of a Dallas strip club, XTC Cabaret, on Feb. 2, 2017.

Prescott denied the claims and filed an extortion lawsuit. He claimed the female accuser and her attorneys demanded $100 million for her silence in a letter he received in January. Prescott’s lawsuit remains active.

After dismissing the accuser’s lawsuit, Judge Tucker scheduled a Sept. 13 hearing to determine if legal action should be taken against the accuser.

“Despite (the woman’s) and her legal team’s relentless efforts to extort money and damage Dak’s reputation, justice has consistently prevailed and will continue to do so,” Prescott’s attorney Levi G. McCathern said in a statement.
